Rule 3
Exercise of Jurisdiction of Tribunal
(1) The jurisdiction of the Tribunal shall be exercised by all the three members collectively (2) Notwithstanding anything contained in sub-rule (1), the case can be processed and disposed of in the presence of a law member and one other member. Apart from the law member, in the presence of two other members, it is possible to take action other than making a decision or giving a final order. In the presence of a law member alone, there will be no hindrance to take action other than to give a decision or a final order in the case.
(3) The opinion of the majority of the members in the presence of all the three members shall be considered as the decision of the tribunal.
(4) If a case cannot be reached in the presence of two members, it shall be decided according to the opinion of the law member in case of a bench with a law member and in accordance with the opinion of a senior member in the case of a bench without a law member. In the case of decision or final order in the case, the opinion submitted before the absent member and supported by him shall be considered as the decision of the tribunal.
(5) If the three members have differing opinions and the majority cannot be established, the appeal shall be sent to the Appellate Tribunal for a decision along with the opinions of the three members and the decision made by the Appellate Tribunal shall be final.
